General Terms and Conditions of Sale

 1. Generale

The general terms and conditions of sale described below apply to all products and services sold exclusively through the Vino Concept e-commerce website.

They define the rights and obligations of the parties.

Vino Concept – Le Cellier reserves the right to modify the content and format of these general terms and conditions of sale at any time.

2. Personal Data

Vino Concept – Le Cellier undertakes to respect the confidentiality of personal data provided by customers on the e-commerce website and to process them in accordance with legal obligations.
Customer data will not be passed on to third parties.

The customer undertakes to provide the personal information necessary for the processing of his order (delivery and billing). This information must be correct, valid, and up to date. Identification details and password must be kept secret by the customer.

3. Sales Process

3.1. Orders

Once the desired product is selected, it is placed in the “shopping cart” by clicking the “Add to Cart” button. The customer can then continue selecting items, modify the shopping cart, or proceed to checkout and payment.

Validation of the order by the customer constitutes acceptance of the general terms and conditions of sale.

Once the order has been confirmed, the customer will receive an order confirmation by email.

This email constitutes our acceptance of your order and therefore forms the sales contract between you and us.

3.2. Prices

The prices indicated per item on the e-commerce website include all applicable taxes but exclude preparation or logistics fees. Shipping costs will be specified before the final confirmation of the order.

Vino Concept – Le Cellier reserves the right to change, without notice and at any time, the prices and other charges displayed on the e-commerce website. However, products will be invoiced to the customer on the basis of the rates in effect at the time the order is confirmed.

We can accept your orders only within the limits of available stock. We cannot provide more precise information on availability. Delivery times are given for information only.

If, despite our vigilance, items are unavailable, we will inform you by email or telephone as soon as possible. If the delay is too long, you may cancel the order and will be refunded the amount paid for the item.

3.3. Product Representation

Vino Concept – Le Cellier undertakes to make every effort to ensure that the photographic representation of the products and services offered for sale on the e-commerce website is as faithful to reality as possible. However, due to the way these products are presented on the internet, the customer’s perception of the product photos may not exactly correspond to the products themselves.

3.4. Secure Payments

Purchases may be paid by bank transfer, PayPal, and – for customers residing and delivered in Switzerland – by invoice.

In accordance with applicable regulations and in order to ensure the security and confidentiality of customer information, Vino Concept – Le Cellier does not store customers’ banking details. It is therefore the responsibility of the customer to save and print his payment certificate if he wishes to retain the payment details relating to his order.

3.5. Delivery

Shipping costs are calculated at the end of the order process, depending on the destination country, weight, volume, and the carrier’s applicable rates. For customers in Switzerland, shipping is free for all orders over CHF 150.00. Delivery charges for bottle racks made of stone, wood, or metal are not included.

The items will be sent to the delivery address indicated by the customer during the ordering process.

We disclaim all liability if the delivered item does not comply with the legislation of the country of delivery.

3.6. Warranty

Items are covered by a 2-year warranty, unless otherwise specified.

The warranty does not cover natural wear and tear, accidental damage, or damage resulting from improper use or impact.

3.7. Returns, Withdrawal and Refunds

Items specially ordered or manufactured cannot be returned or refunded.

From the date of receipt of the product by the customer, the customer has a right of withdrawal, i.e. a period of 10 days to return the delivered product, with return costs at his expense. Only products purchased through the e-commerce website and returned in their complete, intact original packaging may be refunded.

The procedure is as follows:

The item must be complete, properly protected, in its original packaging, and accompanied by any accessories, user manuals, and documentation.

The product must be accompanied by a copy of the sales invoice or delivery slip.

After inspection of the goods, we will issue a refund by bank transfer or PayPal.

If the goods meet the return conditions, a refund will be made. If the goods do not meet the return conditions, they will be reshipped to the customer, who will not be entitled to a refund.

3.8. Impossible Delivery

If delivery of the goods is not possible within a reasonable time, Vino Concept – Le Cellier undertakes to inform the customer and refund the full amount paid by the customer.

The customer may not, under any circumstances, claim compensation for a delivery that has not been made.

4. Retention of Title

The goods remain the sole property of Vino Concept – Le Cellier until full payment has been made.

5. Applicable Law

These general terms and conditions of sale are subject to Swiss law.

The place of jurisdiction is Geneva.
