General Terms and Conditions of Sale
1. General Provisions
These Terms and Conditions (hereinafter referred to as the “T&Cs”) apply to all products and services sold through the e-commerce website operated by Vino Concept.
They define the rights and obligations of the parties.
Vino Concept – Le Cellier reserves the right to amend the content and format of these Terms and Conditions at any time.

2. Personal Data
Vino Concept – Le Cellier undertakes to respect the confidentiality of the personal data provided by customers through the e-commerce website and to process such data in accordance with its legal obligations.
Customer data will not be disclosed to third parties.
Customers undertake to provide the personal information necessary to process their orders, including delivery and billing information. Such information must be accurate, valid and up to date. Customers must keep their login credentials and passwords confidential.
Customers may request the deletion of their personal data at any time by contacting us by email or telephone, subject to any legal obligations requiring us to retain certain data.
3. Sales Process
3.1. Orders
Once the desired product has been selected, it is added to the shopping cart by clicking the “Add to Cart” button. Customers may then continue selecting items, modify their shopping cart, or proceed to checkout and payment.
By confirming an order, the customer accepts these Terms and Conditions.
Once the order has been confirmed, the customer receives an email confirmation.
This email constitutes our acceptance of the order and thereby formalises the sales contract between the customer and Vino Concept – Le Cellier.
3.2. Prices
The prices displayed for each item on the e-commerce website include all applicable taxes but exclude preparation, handling and shipping costs. Shipping costs are displayed before the order is finally confirmed.
Vino Concept – Le Cellier reserves the right to change prices and other charges displayed on the e-commerce website at any time and without prior notice. However, products are invoiced at the prices in force when the order is confirmed.
Orders are accepted subject to product availability. Delivery times are provided for guidance purposes only.
If, despite our efforts, certain items are unavailable, we will inform the customer by email or telephone as soon as possible. If the waiting time is considered excessive, the customer may cancel the order and will receive a full refund of the amount paid for the affected item.
3.3. Product Representation
Vino Concept – Le Cellier endeavours to ensure that photographs of the products and services offered for sale on the e-commerce website reflect reality as accurately as possible.
However, due to the way products are presented online, the customer's perception of the photographs may not correspond exactly to the actual products. Packaging may also differ.
3.4. Secure Payments
Purchases may be paid for by bank transfer, credit card, PayPal or TWINT.
Subject to prior approval, payment by invoice is available exclusively to customers domiciled in Switzerland whose orders are delivered within Switzerland.
In accordance with applicable regulations and to ensure the security and confidentiality of banking information, Vino Concept – Le Cellier does not store customers' banking details.
Customers are therefore responsible for saving or printing their payment receipts if they wish to retain a record of the payment relating to their order.
3.5. Delivery
Shipping costs are calculated at the end of the ordering process, based on the destination country, weight, volume and rates charged by the carrier responsible for delivery.
Items are shipped to the delivery address provided by the customer during the ordering process.
Vino Concept – Le Cellier accepts no responsibility if a delivered item does not comply with the legislation applicable in the destination country, to the extent permitted by applicable law.
3.6. Warranty
Products are covered by a two-year warranty unless otherwise stated.
The warranty does not cover normal wear and tear, accidental damage, damage resulting from improper use, or damage caused by impacts.
Any mandatory statutory rights remain unaffected.
3.7. Returns, Right of Withdrawal and Refunds
Products ordered or manufactured specifically for a customer cannot be returned or refunded, subject to any mandatory legal provisions to the contrary.
From the date of receipt of the product, the customer has fourteen days to withdraw from the purchase and return the delivered product, subject to applicable law. Return shipping costs are borne by the customer unless otherwise required by law.
Only products purchased through the e-commerce website and returned complete and in their original, undamaged packaging may qualify for a refund, subject to the applicable legal requirements.

The item must be complete, unused, properly protected and placed in its original packaging. It must include all accessories, user manuals and relevant documentation.
The returned product must also be accompanied by a copy of the sales invoice or delivery note.
After inspecting the returned goods, and provided the return conditions are met, we will issue a refund using the original payment method (credit card or TWINT) or by bank transfer.
3.8. Impossibility of Delivery
If delivery of the goods proves impossible within a reasonable period, Vino Concept – Le Cellier undertakes to inform the customer and refund the full amount paid.
The customer may not claim compensation solely on the grounds that delivery has not taken place, subject to any mandatory rights under applicable law.
4. Retention of Title
The goods remain the property of Vino Concept – Le Cellier until the purchase price has been paid in full.
5. Applicable Law
These Terms and Conditions are governed by Swiss law, subject to any mandatory legal provisions that may apply.
The place of jurisdiction is Geneva, Switzerland, subject to mandatory jurisdiction rules, particularly those protecting consumers.
6. Language and Interpretation
These Terms and Conditions are available in French, English and German.
In the event of any discrepancy, inconsistency or difference in interpretation between the French version and either the English or German version, the French version shall prevail and be the authoritative version, subject to any mandatory provisions of applicable law.
The English and German versions are provided for information and convenience purposes. This clause does not exclude or restrict any mandatory rights granted to consumers under applicable law.
